2. PHEASANT CREEK HOA BOARD OF DIRECTORS: If Merit says
your request must be presented to the HOA Board and
they don't give you the Boards' contact information,
this means you must attend a monthly Board meeting.
The Board meets the last (4th) Monday of every month
located by the Phase-1 pool area at 7:00 P.M. Anything
that must be approved through the Board must be
presented to them at meetings. The following list of
members was taken from the election result flier posted
on the PC Website, the 06/21/07 BALLOT, and the white
pages.

3. MERIT ARCHITECTURAL & LANDSCAPE COMMITTEE:
If you want to make any architectural or landscaping
changes, then call 800-428-5588, Select OPTION #4 or
send email to: archdept@meritpm.com to put your
request in writing. Merit will forward the
architectural guideline forms to you. You can
verbalize your request at the meetings, but filling
out the forms and putting it in writing generates
faster results. The following forms must be filled
out and submitted to the HOA Board at a monthly
meeting (4th Monday of the month) for approval:

The onsite Maintenance Managers' office is located
by the Phase-1 laundry room. Call Merit for his
name or walk over there during business hours. He
does minor work, such as: cleaning/organizing the
grounds, pool area, empties small trash receptacles,
etc. He also forwards owner/tenant suggestions to
Merit.
5. PHEASANT CREEK ONSITE SUGGESTION BOX:
If you don't have a computer or fax machine, but
want to put any questions, problems or suggestions
in writing (besides using the direct contact
information herein), then suggestion/request forms
are located outside of the onsite Maintenance
Managers' office. Completed forms can be dropped
through the mail slot of his door. If it's a
problem he can solve, then he will. Otherwise, he
will get your request to Merit.
SOME COMPANY SUB-CONTRACTORS/VENDORS ARE
AS FOLLOWS:
If you are experiencing a covered HOA problem and
Joe, Irene or Michael do not call you back, then
call the companies who sub-contract directly with
Merit to do work at Pheasant Creek. These people
want your business ($) and will call, Joe, Irene
or Michael directly to get approval if it is a
job covered by our HOA/Merit. The subcontractors
must have a work order from Merit, first, before
they can do the job. However, if you go direct
and get them to call Merit too, then the squeaky
wheel gets the grease. As a result, you will
receive quicker Customer Service. For additional

need to go through neighboring units' attics.
They punch and seal a hole from the outside dish
area and go through your own attic. The results
are a clean look that is barely noticeable.

· NEW PLANTS: Per discussions between homeowners
at the last HOA meeting, if you want new plants,
flowers, trees (NOTE: no pines due to root issues;
so use common sense) or rocks under your stairs or
in front of your condo, then don't expect Merit to
pay the bill. If you want new landscaping, then
why don't you go buy, plant and maintain it yourself?
How do you think the flowers in front of the condos
got there? How do you think the rocks, plants and
waterfalls got under the stairs? Doing it yourself
will keep our HOA dues down. Don't ask for
permission; ask for forgiveness. The only risk is
that if the landscapers/Merit doesn't like it, they
will simply pull it out, but if you look around,
that is not likely.

25. PLUMBING, BOILER ISSUES & PLUMBERS ARE AS FOLLOWS:
DISCLAIMER: All the following was discussed between
Merit, plumbers and homeowners. However, if you have
concerns, please confirm it by calling Merit and then
contact our Pheasant Creek Webmaster with any updates
for our website:
· INSIDE THE WALL LEAKS: If the leak is coming from
inside the walls, then we file a claim, our HOA dues
pays for it, we must use their sub-contracted plumbers
and those plumbers are reimbursed by Merit, therefore,
we do not pay anything out-of-pocket.
· OUTSIDE THE WALL LEAKS: Any leak coming from an
exposed pipe or valve within the unit that you can see
with the naked eye is considered outside the walls,
therefore, it is the homeowners' responsibility to pay
for it and Merit does not need to get involved. As a
result, we have the following options:
· We have the right to choose any independent plumber
we wish.
· We can make the repairs ourselves if we know how.
· Ask Merit for a referral to their subcontracted
plumbers familiar with Pheasant Creek.
· Turn a claim into our homeowners insurance. The
insurance company will refer you to their
sub-contractor, you pay the deductible and your
premium may go up.
NOTE: MERIT'S INVOLVEMENT WITH LEAK ISSUES: The only
time Merit would get involved with a leak outside the
wall is if the plumber we hire needs access to the
boiler as follows:
· TURNING OFF COLD AND HOT WATER ISSUE: If we hire
our own independent plumber, there is a main turn-off
valve that turns off both the hot and cold water. It
is located in the ground near each unit, it is not
locked and the plumber has free access. The homeowner
must give 24-hour notice to the neighbors re: turning
off the water, except with emergencies or if we inform
our neighbors that day and they don't mind.
· TURNING OFF THE HOT WATER VIA THE BOILER ISSUE:
Boilers are located near the units within a chain
linked fence, which has a locked gate. The lock is a
combination lock. According to the CC&R s, the boiler
systems are considered a common area, which means
homeowners have a right to access this area for free,
like using the pool key. The only difference between
turning off the HOT water from the main valve in the
ground vs. using the boiler is the drainage issue if
you live upstairs vs. downstairs as follows:
· IF YOU LIVE UPSTAIRS ISSUE: People who live
upstairs have the advantage because the water drains
DOWN out of the pipes and the plumber can use the
main outside valve without turning off the boiler.
· IF YOU LIVE DOWNSTAIRS ISSUE: Pipes in downstairs
units may not drain as well; so turning off the HOT
water via the boiler may be necessary because the
boiler contains a lot of water that could back up if
the plumber is not a fast worker.
· CHARGES ($) FOR TURNING OFF THE BOILER ISSUE: This
is being debated. Merit has the combination to the
lock, which allows access to the boiler area to simply
access and turn off two (?) valves, which only takes
seconds. If the sub-contracted, independent or the
Ins. co. plumber insists on turning off the HOT water
via the boiler, then you may need to cancel your
plumber apt and reschedule because Merit will need to
send someone to unlock the gate. Per one homeowner,
Merit charges a $98.00 access fee to open the lock.
Per another homeowner who wanted their dishwasher
installed, Merit missed a re-scheduled appointment
and the Merit sub-contracted plumber charged a $55.00
service fee after Merit did not show up. Therefore,
they never got their dishwasher installed and were
still charged $55.00 by the sub-contractor.
PENDING DEBATE RE: BOILER ACCESS AND MISSED
APPOINTMENT CHARGES ($): Unfortunately, the CC&Rs vs.
Merit's rules are an oxymoron due to CC&Rs that say
free owner access (like the pool key) vs. Merit has
the combo to the lock and charges for access. The
following is currently being debated with the HOA
Board of Directors and Merit:
· Instead of having Merit unlock the boiler, can the
homeowners have the combination?
· If Merit can't get their boiler access person
($98.00 fee) to open the gate at the same time
the Merit plumbing subcontractor is on the
premises, then why should homeowners pay a
$55.00 fee to Merit's plumber if Merit's combo
person misses appointments to open the boiler?
