News regarding CAT case 381/2010

Dear friends,
      As suggested by the Advocate, the additional Rejoinder is being filed in this case. One week time has been given by the Hon'ble CAT to file the Additional Rejoinder and two weeks to the Respondents for reply, if any. Hence, the argument could not happen yesterday. The case is next posted on 22.11.2010. In connection with the CAT case, I was at Ernakulam with Chandrakantha Pladhi for the last two days and the Additional Rejoinder has almost been finalised and will be filed at the earliest. The copy of the Additional Rejoinder will be published in the blog shortly. Hope you all will understand and cooperate.

  2. We were waiting for the final result. Any way, as rightly stated, it is better late than never. Our Defece should be fool proof. CAT normally gives the judgements on the basis of documents only. hope for the best.

  3. I reproduce few lines of the reply to rejoinder, by the Dept. "The Dept of Posts took up the proposal with Nodal Ministry Dept., of Expenditure, Ministry of Finance for extending the same Grade Pay giving DETAILED JUSTIFICATION and their role in organisation". I dont't understand what the Dept. is defending now.

  4. donot get postponements which are happening very frequently. please make the bench to come to a conclusion/decision as early as possible. See, the date of next hearing is 22.11.2010... a month from now!!!

    Your efforts are very appreciable. But I dont belive that department will accept the judgement of CAT. Because IP ASP cadre is most neglecting cadre in the eyes of department.

    Those who said that they will oppose permanand in Delhi are no. 1 enemies of IPO/ASPO cadre. They are like Al-Quiada members in IP/ASPO cadre.Such peoples should be taught a tough lesson. Remember when the scale of Inspectors in Income tax/Central excise got upgraded during 2004 what was the the then or the then C/Ss in all Indian states doing. They remained mute spectators and enjoying the contributions of ordinary members in parties or foreign tours.If the voice would have been raised at that time then the IPOs would have got 4600 GP now.
    Its shameful act .Same peoples have no guts to raise voice for the welfare of IPOs on monetary front.

Hostile descrimination exists in respect of IPOs because they have passed the same competitive examination of Staff commission as that of Inspectors in I.Tax/Central excise/Assistants of CSS.MOF can not deny this. If one cabinet minister gets less pay/allowences than other cabinet minister then what will happen? There will be lot of hue and cry. If Indian Postal Service officers will get less GP/Allowances/facilities than their counter parts in other ministries what will happen?If the DOP thinks IPOs are not comparable with other Inspectors then the entry qualification of IPOs through SSC should be made 10th class with the help of DO&PT for the smooth functioning of DOP.If DOP can not think positively for IPOs GP then think atleast to bring LOWER STANDARD matriculates in IPO cadre through Staff selection commission so that lower GP of 2000 can be given to IPOs and huge fund can be saved for DOP/MOF.Alternativly sytandard of Indian Postal Services should be reduced and soem Management graduates shoudl be brought and Indian Postal service can be replaced by Management graduates.

  13. Hi friends I am selected for Inspector of Posts for joining I am to be called in Patna, Bihar. Is there any inspector to guide me whether I should join or not. what/How much/which type work load is there in Bihar circle. what is future prospect? Whether training will be done, if yes how long. I am present Assistant, Central Autonomous body with 4200/-
    G.P. three increments too. with Govt. qurarters. living in Delhi. I had applied through proper channel whether pay protection will be given. My native state is Bihar. Plz guide me what to do?

  14. Nice to see the Addition Rejoinder filed in the case. Almost all the points raised by the Dept. are effectively and convincingly countered. Most importantly, the Dept. in the reply was trying to establish the parity between Gr.B officers of CBDT/CBEC/CSS and Dept. of Posts disturbing the parity of Inspectors. Additional Rejoinder is very effective.

  15. Let us see how the Dept. of Posts defend this time. It seems the DOP was defending the case without noticing that Secretary, MOF Dept. of Expenditure is the first respondent in the case. The hearing on 22.11.2010 may be final hearing.

  18. Yes, Premananda and his team is in the winning trend. So far CAT, Ernakulam has produced many landmark judgments which reached finality. I hope OA 381 of 2010 is one amongst them.

  21. We can also highlight that there is no much functional disparity between ip and asp to give equal grade pay of Rs.4600 as subdivisions may upgrade and downgrade at any time as per the conveience of administration without change in nature of work.

  22. Dear jayanth Jee,
    We should wait for the defence by the Dept. of Posts / MOF. If we point out now that there is no functional differences between IP and ASP, we will give a chance to the Dept. to defend. At present Dept. has no defence on the following points:
    1. The contention that only Gr.B posts in CBDT/CBEC/CSS and DOP are comparable, ignoring the parity at Inspector/ Assistant level, as recognised by 5th and 6th CPC is against the recommendation of 6th CPC in Para 3.1.3 and accepted & acknowledged by the Govt. in OM dated 16.11.2009. Para 3.1.3 clearly state that parity between field staff and secretariat staff would need to be absolute upto the grade of Assistant and beyond this it might not possible or even justified to grant complete parity.
    2.On what grounds the pay scale of Inspector CBDT/CBEC was upgraded to Rs.6500 in April'2004 and no such upgradation was given to Inspector Posts. This was pointed our by the Hon'ble CAT Bangalore Bench in OA No.424/06.
    3.On what basis the parity agreed by the 5th & 6th CPC among Inspector Posts, Inspector CBDT/CBEC and Assistant in CSS are being disturbed.
    4. As far as hierarchy is concerned, Inspector Posts is the feeder cadre for promotion to the SPOs cadre in similar ways as Inspector / Assistants are feeder cadre for promotion to the Supdt./SO Cadre.

  25. Assistant of Intelligence Bureau prerevised Scale 5500-9000/- after pay commission 4200/- G.P. has also been upgraded to G.P. 4600/- one month ago.

    If u are getting 4200 GP u should wait for the CAT decision filed in Kerala for 4600 GP.If 4600/- GP is rejected u should avoid for Inspectors Post. Delhi has 30% HRA. In Patna U may get 10% or 20% HRA. Further Inspectors are treated as beggars by IPS officers who are selected from UPSC. Remember U can earn good money in Postal department if U are not honest. If honesty is not in your blood you may join in DOP.In every stage every body higher than Inspectors think that they are IPS selected from UPSC.
