OA No. 381/2010 - Present status

Our case OA No.381/10, which was posted today could not be heard as only one bench functioned today. The next date of posting will be known within a day or two. Moreover, the Respondents have not filed the reply to the Additional Rejoinder till today. Perhaps Respondent may request one or two week time before the Tribunal to reply the same. Further progress will be intimated shortly.
05.12.2010 : Our case has not been listed so far in the absence of Division Bench at CAT Ernakulam. We are in constant touch with our counsel. Any development in this regard will be intimated soon.

  1. Why can't we oppose respondent seeking further time to file reply, as already ample time has been taken by them.

    We can request the CAT to direct them to put forth their responses in arguments instead of wasting time to file reply.

    Please consult the lawyer on this aspect.

  3. Advocate has already been consulted. He will definitely oppose any extension of time sought by the respondents. But it has to be decided by the Tribunal. Our Advocate is one of the best Advocate at CAT/High Court. Any way thanks for the comments.

  4. Dear comrades
    Finally we have won the battle in Chennai High Court. Our demand for granting 5400 GP to Inspectors with ACP(4800 grade pay) after 4 years was rejected by CAT Chennai & Ernakulam. Without getting disappointed we have filed another OA in CAT Hyderabad for which the dept. is taking extension of time now and again. Meanwhile the Chennai High Court has given a reasonable order (expate)after adjourning the case three times on the request of dept. but failed to file counter. The order can be accessed on http://hyderabadcustoms.blogspot.com. Why I am telling this all is only to tell you not to worry and keep going. you are going to succeed. The dept. can not runaway if they are asking for extension of time. All the best.

    I appreciate your support. You being in other deptt is also supporting the CAT case filed by Permanadji. I have seen and observed that in Department of Posts many Officers of your rank are not supportive with 4600 GP to Inspectors of Posts. Due to this tendency and attitude they themselves helped respondents i.e.CPMGs/DG office to prepare negative reply for the CAT case filed by Permanandji. They have tried fully to defeat Permanadjis move. The Inspectors of Posts are also selected from same examinations i.e. SSC and your Inspectors in Central Excise are also from same examination.Now for GP issue caste like system is being applied for Inspector of Posts. What will happen if the Indian Postal Service Officers (IPS) will get less Grade Pay then their counter parts in other departments.In such situation IPS officers can come on streets for equal status or eaqual GP.However the same peoples/officeers are twisting the matter of 4600 GP for Inspecto of Posts despite clear recommendation by 6th Pay commission. You can imagine how we are treated by Department of Posts. I salute Rajuji for your support and wishes. Hope our General Secretary Shri Roop Chand and his company or all Circle Secretaries of department of Posts will learn some lesson from the comment of Rajuji. Department of Post is treating Inspectors of Posts as a beggars.

    Where are you?. Whats going on after Conference at Ahmedabad.What is status of the CAT case?.I feel the Association is now realising real face of DG /Top level officers at Dte and their attitude towards IPOs/ASPOs. Please comment. I feel IPOs should not feel if ASPOs get higher GP but the fact is fact i.e. IPOs must get 4600 by hook or crook.

    Tribunal was closed from 24.12.10 to 02.01.11 and opened only on 03.01.11. I am in constant touch with our counsel. We hope that Our case will be listed within one week. I was waiting for the development in the CAT case and hence no posting is made. With all your support, Original application, Rejoinder and Additional Rejoinder have already been filed in the case. Reply to the additional Rejoinder has not been filed so far by the Respondents. Even if the Respondents don't submit the reply, the case may be decided by the Tribunal. Counsel has already been asked to oppose any move by the respondents to take further extention for filing the reply. We will get some news within two or three days. Hope U all will understand and support us in future also.

Efforts are highly commendable and appreciable and we will see that DOP would have now nothing left to say except to bow before Hon'ble Court. Surely and certainly justice would prevail.
